Should Employers Mandate Covid-19 Vaccines?

After much anticipation, Covid-19 vaccines are being administered around the country, and the eagerly anticipated return to “normal” does not seem quite so far off. However, with a disease as readily communicable as Covid-19, considerations regarding the return to the workplace include questions as to whether an employer can and should mandate vaccination prior to the return to the office. The EEOC has issued guidance which appears to indicate that mandated vaccines are permissible; however, the deeper question is whether an employer should mandate vaccination.

While mandated vaccinations would likely decrease the impact of Covid-19 on the workplace, requiring employees to obtain a vaccination prior to returning to work does present numerous additional hurdles for employers.
